Terms and Conditions of Use

Access to and use of this site are subject to the present general terms and conditions of use detailed below, as well as applicable laws and/or regulations. This site complies with applicable European and French regulations on personal data protection. Browsing this site constitutes unconditional acceptance of the following terms and conditions of use. The currently online version of these terms is the only enforceable version, for the entire duration of use of the site and until a new version replaces it. Any User who uses the website acknowledges having read these general terms and conditions of use (the "T&Cs") and agrees to comply with them.


1. PURPOSE

These T&Cs aim to define the terms and conditions of use of the website by Users.

3. CONDITIONS OF ACCESS TO THE WEBSITE

3.1. General
Access to the site is reserved for adults. The Publisher reserves the right to request proof of the user's age. Access to and use of the site are reserved for strictly personal use. Users agree not to use this site or the information or data contained therein for commercial, political, or advertising purposes, or for any form of commercial solicitation, including the sending of unsolicited emails. Users are also informed that the Publisher may decide, at any time and without notice, to modify, suspend, or permanently close the site's services.

3.2. Technical Requirements
It is the User's responsibility to obtain a smartphone, tablet, PC, operating software, browser, and all software and IT equipment ("Equipment") necessary to access the website. The User agrees to secure this Equipment, to have subscribed to an internet access contract with a provider of their choice, and not to engage in behaviour contrary to laws and regulations that could result in the termination or suspension of their internet access. The site's services may be impaired if the User does not use appropriate Equipment. The User bears the costs of Equipment and connectivity related to internet access for use of the website.

5. USER OBLIGATIONS

In all cases, the User remains solely responsible for their use of the website in violation of the T&Cs, laws and regulations, or any agreement binding them to third parties.


6. PUBLISHER'S RIGHTS AND OBLIGATIONS

6.1. Availability
The Publisher undertakes to implement reasonable means, in accordance with best practices, to allow access to and use of the website 24/7. However, the Publisher does not guarantee that the website will be free of anomalies, errors, or bugs, that these will be corrected, that the website will operate without interruption or failure, or that it will be compatible with any particular Equipment or configuration.

6.2. Updates and Maintenance
The Publisher reserves the right, without notice or compensation, to temporarily suspend the website or access to one or more of its services, including in cases of force majeure, third-party actions, or to carry out updates, maintenance, modifications, or changes to servers. In the event of a planned interruption during business days and hours lasting more than one day, notice will be given via a warning on the site's homepage or by any other means.

6.3. Security
The Publisher makes its best efforts, in accordance with professional standards, best practices, and applicable regulations, to secure the website and the data processing carried out through its use.


7. LIABILITY

By express agreement, the Publisher is bound by an obligation of means. The Publisher shall not be held liable for direct or indirect damages resulting from any of the following situations:

  • The Publisher cannot be held liable for damages resulting from difficulties accessing the website due to disruptions by electricity providers, network operators, or internet service providers, network congestion, poor coverage, or failures in the User's IT installations and equipment, it being noted that the User alone chooses the internet service provider for access to and use of the website.

  • The Publisher is not responsible for damages of any nature resulting from changes to the website's services and/or anomalies, errors or bugs, temporary unavailability, or permanent closure of all or part of the site.

  • The Publisher disclaims all liability for use of the website contrary to the T&Cs, laws and regulations, and the rights of third parties. The Publisher's liability shall in no case be engaged for any indirect or intangible damages.


8. INTELLECTUAL PROPERTY RIGHTS

8.1. Publisher's Intellectual Property Rights
The website is the exclusive property of the Publisher or of the third party holding the corresponding rights. Any deterioration, and, in the absence of prior express authorisation from the Publisher, any representation, reproduction, modification, translation, commercial use, in whole or in part, of the various elements of the website is prohibited and exposes its author(s) to prosecution, including criminal proceedings. As such, Users agree not to reproduce the website and its documentation, in whole or in part. All content included in or accessible on and/or through the website — including all graphics, images, photos, drawings, maps, logos, names, trademarks, matrices, tables, charts, texts and other documentation, databases, and any other material or software — is the exclusive property of the Publisher or of third parties who have authorised the Publisher to use or display them on the site. 9. CONFIDENTIALITY AND PERSONAL DATA

The Publisher attaches fundamental importance to the privacy of its Users and the confidentiality of their personal data ("Personal Data"). 9.1. Data Controller
The Personal Data communicated by the Client in connection with use of the website is collected by the Publisher. By using this site, the User expressly accepts the rules for collecting and using Personal Data described below.

9.1.1. Nature of Personal Data Collected
The Personal Data that may be collected by the Publisher includes, without limitation:

  • First name, last name, email address, phone number, postal address;

  • The User's IP address and connection data.

Note: Users' IP addresses will be systematically anonymised before being shared with our partner Google Analytics.

9.1.2. Purposes
The Publisher processes Users' Personal Data collected for the following exclusive purposes, necessary for the performance of obligations under these T&Cs and/or carried out with the User's express consent:

  • Processing necessary for the performance or preparation of a contract with the User;

  • Operation of the website as described in these T&Cs;

  • Improvement of the website's operation;

  • Sending the Client information about the website;

  • Sending the Client commercial information;

  • Compliance with the Client's reservation.

Users may withdraw their consent to the processing of their personal data at any time by requesting the closure of their account. Unless subject to legal or regulatory obligations, closure of the account will result in the cessation of processing and the permanent deletion of all data (personal and technical) entered.

9.1.3. Recipients of Collected Personal Data
Personal Data collected from the Client is processed by the Publisher on the website and/or in the Publisher's customer relationship management applications connected to the site. The Publisher may nevertheless be required to communicate Personal Data to comply with applicable legislation or to respond to requests from public or governmental authorities. In such cases, prior notification will be sent to the relevant Client, unless the Publisher is not required to do so under applicable legal and regulatory provisions. The Publisher does not transmit any collected Personal Data to third parties other than those mentioned above for any reason.

9.1.4. Retention Period
The Publisher does not retain collected Personal Data beyond the period strictly necessary for the purposes of the processing concerned. Personal Data is retained throughout the business relationship and then for two (2) years from the end of that relationship.

9.1.5. Client Rights
In accordance with and within the limits of Articles 12 to 23 of the GDPR, Users have the right of access, rectification, portability, deletion, and objection to the processing of data concerning them. 9.1.6. Use of Cookies
A cookie is a small text file containing information relating to Users' activity on the website. It maintains the User's connection to the site without requiring authentication details to be re-entered each time. It also remembers certain preferences without needing to ask for them again on each visit. Finally, it allows the Publisher to improve the website based on User activity. All notices between the User and the Publisher, to be valid, must be sent by registered letter with acknowledgement of receipt:

  • To the Client's address as recorded in their account.


17. APPLICABLE LAW AND JURISDICTION

These T&Cs are governed by French law. In the event of any dispute regarding the validity, interpretation, and/or performance of these T&Cs, the courts within the jurisdiction of the Court of Appeal of Angers shall have exclusive jurisdiction.
